Welcome to the Mitigate AI Platform (hereinafter — the "Platform"). The Platform is jointly maintained and operated by SIA Mitigate (Reg. No. 50103381201) and Mitigate AI Services SIA (Reg. No. 40203603914), registered address: Gustava Zemgala gatve 74A, Riga, LV-1039, Latvia (hereinafter collectively referred to as "Mitigate" or "we"). Depending on the contractual relationship, the direct service provider for your Organization may be SIA Mitigate or Mitigate AI Services SIA.
These Terms of Service (hereinafter — the "Terms") govern the use of the Platform and its services. By accessing or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, use of the Platform is not permitted.
1. Definitions
Platform: The Mitigate AI Platform, available at ai-platform.mitigate.dev, where Organizations can create and manage AI conversation agents with customized knowledge bases, connectors, and workflows.
Organization: A legal entity that registers an account on the Platform and manages User access, workspaces, and AI configuration.
User: A natural person — a representative of the Organization who accesses and uses the Platform.
Workspace: An isolated environment within the Organization with a separate knowledge base, AI configuration, connectors, and conversation history. Data between workspaces is fully separated.
AI Agent: An AI conversation system configured on the Platform that uses large language model (LLM) technology to answer questions, analyze documents, and execute workflows.
Connector (MCP): An integration with an external service (e.g., Google Workspace, Microsoft 365, Atlassian, Slack) that allows the AI agent to access external data on the User's behalf.
Knowledge Base: A collection of documents and website content uploaded to the Platform by the Organization to provide the AI agent with the necessary context and information.
Workflow: An automated sequence of actions executed by the AI agent based on a trigger event (e.g., email received, Jira task created, schedule).
Embedded Chat: The Platform's chat interface integrated into third-party websites or applications.
User roles:
- Owner: A User with full administrative rights — management of workspaces, users, connectors, and AI configuration.
- Administrator: A User with access to the Platform's administration panel and most settings.
- Member: A User with access to chat functionality in assigned workspaces.
2. Account creation and maintenance
By creating an account and accepting these Terms, you confirm that you have the legal authority to bind the entity you represent. If you do not have such authority, you are personally liable for any losses arising from unauthorized commitments.
The Organization's Owner is responsible for:
- Managing User access and deactivating inactive users;
- Workspace configuration and data management;
- Selecting an appropriate AI service provider in accordance with the Organization's requirements.
3. Services
The Platform provides the following services (including but not limited to):
- AI conversation agent — a configurable conversation system with a customized knowledge base;
- Knowledge base management — document upload, website indexing, AI enrichment;
- Connector integrations — connections to external services (Google, Microsoft, Atlassian, Slack, GitHub, Zendesk, Sentry, Redmine, etc.);
- Workflows — automated actions executed based on trigger events;
- Embedded chat — integration of the AI conversation interface into third-party websites;
- API access — programmatic access to Platform functionality.
Specific service types and their descriptions are available on the Platform. The range of services may change over time.
4. User conduct
You are fully responsible for the data you upload or process on the Platform and for AI-generated content. You agree to:
- Use the Platform in accordance with all applicable laws and regulations;
- Not upload content that is illegal, harmful, or infringes third-party rights;
- Not attempt to circumvent the Platform's security mechanisms or access controls;
- Not attempt to use the Platform to harm other systems or services;
- Not use the Platform to generate content that is misleading, discriminatory, or harmful.
5. Restricted jurisdictions and persons
Use of the Platform is prohibited:
- Sanctions lists: Use of the Platform is prohibited in connection with natural or legal persons included on EU, US, UK, or UN sanctions lists, or located in jurisdictions subject to international restrictions.
- Use for the benefit of Russia or Belarus: Use of the Platform for the benefit of or in the interests of the Russian Federation or the Republic of Belarus is prohibited, including in cases where it could directly or indirectly facilitate the circumvention of international sanctions.
Mitigate reserves the right to suspend or delete user accounts without prior notice and without refund if there are reasonable grounds to suspect violations of sanctions or export controls.
6. Data protection and ownership
- Data encryption: All data is encrypted in transit and at rest.
- Workspace isolation: Data is fully separated between organizations and workspaces. One Organization cannot access another Organization's data.
- Data access: We do not access your data unless you grant access for support purposes.
- Data retention: Conversation data retention periods are configurable at the Organization level. Account data is deleted upon request or automatically if the User has not used the account for 12 (twelve) months.
- Data ownership: Organizations retain ownership of uploaded documents, knowledge base content, and conversation data. Mitigate retains ownership of all Platform content, technology, and intellectual property.
- Organization's responsibility: The Organization, as the data controller, is responsible for the lawfulness of data processing within its workspaces, including User management, compliance of uploaded content with applicable regulations, and data deletion. Mitigate provides the technical means for data management.

7. AI technology
The Platform uses large language model (LLM) technology to deliver various services. Specific service types and their descriptions are available on the Platform.
Choice of AI service provider: The Platform supports multiple third-party AI service providers. The Organization or its Users may select the preferred AI service provider from the options available on the Platform. Available service providers may change over time.
AI technology disclaimers:
- AI-generated content is informational in nature and may not always be accurate or complete;
- Users are responsible for verifying AI outputs before making any decisions;
- AI functionality supports human decision-making and does not replace professional judgment;
- Mitigate assumes no liability for decisions made based on AI-generated content.
Third-party service providers: The AI technology integrated into the Platform uses third-party LLM services. Mitigate manages relationships with third-party AI service providers and ensures compliance with regulatory and privacy requirements. The Platform assumes no liability for errors or disruptions in third-party AI technology. By using the Platform, the User also undertakes to comply with the terms of use and policies of the selected AI service provider.
8. Connectors and external services
The Platform provides connectors for integration with external services. When using connectors:
- The User authorizes the connection with their personal authorization credentials (OAuth) and is responsible for the permissions granted;
- Data from external services is processed within the AI agent's context and may be retained in conversation history;
- Mitigate assumes no liability for the availability, accuracy, or security of external services;
- The User is responsible for compliance with the terms of use of external services.
9. Embedded chat
The Organization may integrate the Platform's chat interface into its own or third-party websites. The embedded chat supports three modes:
- Authenticated — the user is identified through an encrypted token (JWE);
- Guest registration — the user provides their name and email address;
- Anonymous — no identification is required.
The Organization that integrates the embedded chat is responsible for:
- Informing its end users about data processing in accordance with applicable regulations;
- Obtaining the necessary consents from its end users;
- Secure generation and management of encrypted tokens (JWE) (in authenticated mode).
10. Limitation of liability
The Platform is provided "as is". Mitigate's liability for losses arising from the use of the Platform is limited to direct damages and shall not exceed the amount paid by the Organization for Platform services in the preceding 12-month period.
Mitigate assumes no liability for:
- The accuracy or completeness of AI-generated content;
- Decisions made based on AI outputs;
- Disruptions in third-party services (LLM providers, connectors);
- Data loss caused by User fault or negligence;
- Embedded chat end user conduct or data processing compliance.
11. Termination
User-initiated termination: You may terminate your account by sending a request to legal@mitigate.dev.
Data deletion after termination: After account closure, all Organization data (documents, knowledge base, conversation history, configuration) will be irreversibly deleted within 30 (thirty) days.
Automatic deletion: If the User has not used the account for 12 (twelve) months, data will be automatically deleted.
Data export: Before termination, the Organization may export its data using the Platform's export functionality or API. After the 30-day period, data recovery is not possible.
12. Amendments and notices
We may update these Terms from time to time. Users will be notified of significant changes via email or through the Platform at least 30 days before the changes take effect. By continuing to use the Platform after the changes, you agree to the updated Terms.
13. Indemnification
Organizations and Users agree to indemnify Mitigate against any liabilities, losses, or expenses arising in connection with the use of the Platform, particularly if they have breached these Terms or applicable regulations.
14. Force majeure
Neither Party shall be liable for delays or failure to perform obligations under these Terms if caused by circumstances beyond their control, such as natural disasters, pandemics, cyberattacks, or other unforeseen events.
15. Dispute resolution
Any dispute arising from these Terms that cannot be resolved through negotiation shall be submitted to the courts of the Republic of Latvia in accordance with Latvian law.
16. General provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Failure by Mitigate to exercise any right provided under these Terms shall not constitute a waiver of that right.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mitigate regarding the use of the Platform.
